Balloon designs and balloon delivery and balloon gifts will be created in accordance with the specifications discussed and agreed upon by Parties that Pop, 10609 Elizabeth Parnum Place, Upper Marlboro, Maryland 20772 and customer, also referred to as client. The work will be performed and completed in a professional and substantial workmanlike manner.
Payment and Refund Policy—No Refunds. All sales are final. No exceptions.
Payment must be received upon issuance of an invoice. Parties That Pop will accept a partial payment. However, this payment arrangement is discretionary. If a partial payment arrangement is accepted, final payment must be received 21 days prior to the event. Failure to make the final payment 21 days prior to the event will void the agreement and no further arrangement will be made. Refund Policy—No Refunds. All sales are final. No exceptions.
Cancellation and Postponement.
Inclement weather. Pandemics. COVID Virus. National Security and National Emergency. Local Emergency. In case of inclement weather, i.e., rain, flood, hail, sleet, snow, thunder and lightning storms, strong winds, heat, cold, and other inclement/and/or extreme weather conditions, and Parties That Pop is prevented from providing the agreed upon work, no money will be refunded. Parties That Pop has no control over weather conditions, and accepts no responsibility. However, Parties That Pop will make every reasonable good faith effort to deliver as contracted. Parties That Pop will rely on the recommendations of meteorologists both local and national. If the event is canceled before Parties That Pop receives the final payment, the materials and supplies become the property of Parties That Pop and no money will be refunded –however, the client is under no obligation to make the final payment. In emergency, or situations beyond Parties That Pop’ control, i.e., medical, mechanical, national disaster, traffic back-ups (but not limited to), where driving conditions and public or personal health/safety is a concern and Parties That Pop is unable to deliver contracted decorations or design, there will be no refund and Parties That Pop will not be held liable. Again, Parties That Pop will make every reasonable good faith effort to deliver as contracted. Parties That Pop will rely on the recommendations of area law enforcement and/or the local news, and/or doctor(s), depending on the circumstances. If there are any forewarnings, that may jeopardize the timeliness of a delivery for an event, i.e., inclement or extreme weather conditions, national security and national emergency, or local emergency and disaster issues, transportation concerns, (but not limited to), and Parties That Pop communicates the concern to the client, it becomes the responsibility of the client to make adequate accommodations. When pandemics and/or contagious disease(s) are concerned, Parties That Pop representative(s) wear Personal Protective Equipment (PPE), practices washing hands frequently, and practices the 6-foot distance rule during delivery and installations. We ask that the client reciprocate. We further ask that the client provide a safe working environment for Parties That Pop. If at any time Parties That Pop feels unsafe, we will communicate our concern(s) to the client, and if there is not a remedy to ensure our well-being, Parties That Pop will leave the premises immediately. The delivery will be deemed “Undeliverable” by Parties That Pop. Parties That Pop. If Parties That Pop is unable to deliver contracted decorations or design for any of the above-referenced reasons, Parties That Pop is willing to compensate the client by arranging with the client to decorate for a future event at no additional cost to the client. In this event, the time and date of the event must be agreeable with Parties That Pop.
Photographic Inspirations. Atmospheric and Foreign Elements. Usage Rights:
Any alteration or deviation from original design involving extra costs, will be executed only upon written order, and will become an extra charge over and above the original cost. Further, any alteration and/or deviation from the original agreed upon work product delivered by Parties That Pop and altered by the client or its representative(s), voids any and all maintenance agreements, and/ or any other agreements between the client and Parties That Pop. Once the integrity of Parties That Pop final work product has been moved, altered, and/or tampered with, it is no longer a Parties That Pop product. Parties That Pop commissioned designs and or services may be changed and/or altered by Parties That Pop based on availability of supplies and/or materials and/or services. Many of our designs are difficult because of the technical techniques and methods used to create them. They are custom architectural designs that cannot be changed at the time of delivery and setup. Atmospheric and/or foreign element(s) may also affect the contracted design; and/or venue design and/or specifications, i.e., spackled ceilings and/or high ceilings and/or lack of rigging points and/or the possibility of many variables that are not anticipated and are not specifically articulated, including venue rules and regulations. Custom balloon décor and any other décor or services will vary from photographs provided by the client or by Parties That Pop. Parties That Pop will make every good faith-effort to replicate the design concept from photographs provided by the client and/or Parties That Pop. Parties That Pop will use photographs and/or design ideas as a way of communicating the concept of design for balloons, flowers and all decorations provided by Parties That Pop. All of our balloon designs are one-of-a-kind and customized for each event and the final design will almost never be exactly the same. Balloon Garlands and Organic balloon designs will never be an exact design of a pictured inspiration because of the free-style process of our designs. Atmospheric and/or foreign element(s) may also affect the contracted design resulting in balloons popping and/or balloon shrinkage. If this is the case, it is beyond the control of Parties That Pop and Parties That Pop will not be held liable. No refund will be issued.
Parties That Pop uses 100% natural latex that is biodegradable. Atmospheric conditions, both indoor and outdoor, may affect the appearance of the balloons, or the effect on the balloons causing them to pop/and or oxidize. Parties That Pop accepts no responsibility. Balloon release into the atmosphere is the sole responsibility of the client and Parties That Pop accepts no responsibility and/or liability. Parties That Pop does not perform or endorse balloon releases. (Ask us why.) Check state and local laws and ordinances.
DISCLAIMER: Parties That Pop is not liable for the ingestion of balloons or its non-flammable gases, to include, helium and/or nitrogen, nor any other material provided by Parties That Pop. The ingestion of balloons, its gases, and/or any foreign object can result in serious injury or death. Parental supervision is recommended for children under 12 years old.
Further, it is understood based upon full or partial payment of money via, check, cash, credit card, money wire, or electronic payment to Parties That Pop by the client or its representatives that the client agrees and accepts our Terms and Conditions to be binding. Refunds—No Refunds. All sales are final. No exceptions.
Access to workspace and timing of work. Design Change.
Since the average decorating time is three (4) hours, Parties That Pop must have access to the workspace at least three (4) hours prior to the scheduled event. Parties That Pop will make every effort to ensure that access to the workspace is available. However, it is the responsibility of the client to make the necessary arrangements for Parties That Pop to access the workspace. Parties That Pop cannot guarantee delivery of contracted decorations if access to workspace and timing of the work requirement is not met. If the client makes a design change, there is an additional fee of 25% for the design change to be paid at the time of the design change.
Usage Rights: Event Images and Videos of Parties That Pop Balloon Designs, Rentals and/or all services or materials rendered by Parties That Pop.
Images and videos taken by Parties That Pop or purchased by Parties That Pop or gifted to Parties That Pop from authorized parties or images or videos of our work that may come to us by a chance encounter and/or found on line, will be used for promotions, marketing, and portfolio purposes, including, but not limited to: social media (Instagram, Facebook, TikTok, X, Pinterest, LinkedIn, YouTube, WhatsApp, Messenger, and others that may not be explicitly named here, but considered as social media; our websites and online portfolios; advertising and printed materials; educational content and tutorials. We will use such images to grow our brand. Parties That Pop will not be held liable for any violation(s) of invasion of privacy or copyright infringement. Photo/video credit will be given if provided to Parties That Pop.
Strike or tear down arrangements.
After the event, Parties That Pop will return to strike or tear down the decorations, and pick-up all supplies, materials, frames, and hardware that are the property of Parties That Pop. Parties That Pop will reasonably clean up the debris from the balloons and/or special effects provided by Parties That Pop. Clients must arrange for Parties That Pop to return for striking or tear down of decorations at the time balloons are ordered; or prior to the day of event. Parties That Pop must agree to return at the agreed upon time with the client. Additional cost of 15% of the job will be billed if Parties That Pop has to wait 15 minutes or more to gain access for striking at the agreed upon time.
Rental Property. Lost, Damaged Property. Stolen Property.
Parties That Pop’s property that is lost, damaged or stolen while on loan or rental during your event will be billed to the client at retail value. All balloon framing, backdrops with framing, materials, weights, wreaths, table décor, i.e., flowers, tulle, candle holders, mirrors, lighting, and other specialty items are the property of Parties That Pop (unless otherwise specified on the Invoice Description). Please do not make any changes to framing material or hardware while on loan or rental. Parties That Pop will allow thirty business days to collect for such charges.
Please Recycle: Latex balloons are biodegradable and can simply be popped and disposed with plastics. Foil (mylar) balloons should be recycled with cans. Never release balloons, foils or latex, into the atmosphere. Please call Parties That Pop for more information regarding proper disposal of balloons.

Terms and Conditions Acceptance. It is understood based upon full payment of money (or monies) to Parties That Pop by the client or its representatives, agrees to the content of these terms and conditions herein, and that the terms and conditions are accepted and binding.
The above prices, specifications and conditions are satisfactory and are hereby accepted. Parties That Pop is authorized to do the work as specified above. Payments will be made as outlined above.
